LEGAL TERMS, WAIVERS, & PRIVACY POLICY

Effective Date: October 1, 2025


1. OVERVIEW & ACCEPTANCE OF TERMS

The Great American River Race (“TGARR”) is a privately organized endurance boating challenge operated by TGARR LLC (“TGARR,” “we,” “us,” or “our”).

By accessing this website, registering for the event, participating in any TGARR-related activity, or being present as a participant or crew member, you acknowledge that you have read, understood, and agreed to be bound by these Legal Terms, Waivers, and Privacy Policy (collectively, the “Agreement”).

If you do not agree to these terms, do not register or participate.


2. NATURE OF THE EVENT

TGARR is not a guided tour, regatta, rally, or supported expedition.

TGARR is a participant-controlled endurance boating event conducted on navigable waterways subject to:

  • Commercial vessel traffic
  • Changing river conditions
  • Weather, debris, and infrastructure hazards
  • Mechanical failure
  • Fatigue, stress, and judgment errors

TGARR provides rules and a framework only. Participants retain full responsibility for all decisions, actions, and outcomes.


3. ASSUMPTION OF RISK

Participation in TGARR involves inherent and significant risks, including but not limited to:

  • Serious bodily injury or death
  • Property damage or loss
  • Collisions or allisions
  • Wake damage
  • Groundings or mechanical failures
  • Delayed or unavailable emergency assistance

By participating, each participant knowingly and voluntarily assumes all risks, whether known or unknown, foreseeable or unforeseeable, arising from participation in TGARR.


4. PARTICIPANT RESPONSIBILITY

Each participant is solely responsible for:

  • Vessel condition and seaworthiness
  • Lawful operation of their vessel
  • Navigation and right-of-way decisions
  • Fuel, repairs, rest, and logistics
  • Crew conduct and readiness
  • Compliance with all applicable laws and regulations

TGARR does not direct vessel operation, navigation, speed, routing, or right-of-way decisions.


5. RELEASE OF LIABILITY

To the fullest extent permitted by law, each participant releases, waives, discharges, and covenants not to sue:

  • TGARR LLC
  • Event organizers
  • Officers, directors, and employees
  • Volunteers, contractors, and advisors
  • Sponsors, partners, and affiliates

(collectively, the “Released Parties”)

from any and all claims, demands, losses, damages, or liabilities arising out of or related to participation in TGARR, including claims based on ordinary negligence.

This release does not apply to gross negligence or willful misconduct where prohibited by law.


6. THIRD-PARTY & PROPERTY DAMAGE INDEMNIFICATION

(CRITICAL LIABILITY ALLOCATION)

Each participant agrees to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, demands, damages, losses, liabilities, judgments, fines, penalties, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Injury to or death of any third party
  • Damage to real or personal property of others
  • Claims by other participants, spectators, vessel operators, property owners, or governmental entities
  • Acts or omissions of the participant or any member of the participant’s crew
  • Operation, condition, or use of the participant’s vessel or equipment
  • Violations of laws, regulations, or navigation rules

This obligation applies even if such claims are caused in part by the negligence of a Released Party, except where prohibited by law.


7. MARITIME NAVIGATION & COLLISION RESPONSIBILITY

Participants acknowledge and agree that:

  • They are solely responsible for compliance with U.S. Coast Guard regulations, Inland Navigation Rules, and all federal, state, and local laws
  • TGARR does not control navigation, vessel movements, or traffic interactions
  • Any collision, allision, grounding, wake damage, or navigational incident involving a participant’s vessel is the responsibility of the participant, not TGARR

Participation in TGARR does not exempt any participant from lawful enforcement actions.


8. CREW JOINT & SEVERAL LIABILITY

Each participant understands and agrees that:

  • Each crew member is individually responsible for their actions
  • Participants associated with a vessel are jointly and severally liable for claims arising from the operation of that vessel
  • TGARR may seek indemnification from any or all participants associated with a team or vessel

9. BOAT OWNER & CREW RESPONSIBILITY SPLIT

  • The vessel owner and/or captain is responsible for:
    • Vessel condition and seaworthiness
    • Insurance coverage (if any)
    • Lawful operation and compliance
  • Crew members are responsible for:
    • Their own conduct and decisions
    • Actions contributing to injury or damage

Nothing in TGARR’s rules or communications transfers responsibility for vessel operation to the event organizers.


10. MEDICAL & INSURANCE ACKNOWLEDGMENT

Participants acknowledge that:

  • TGARR provides no medical screening, medical staff, rescue services, liability insurance, hull insurance, or medical insurance
  • Emergency assistance may be unavailable or delayed
  • Any insurance coverage is solely the participant’s responsibility

Participants authorize emergency medical treatment at their own expense if deemed necessary.


11. DISQUALIFICATION & EVENT MODIFICATION

TGARR reserves the right, at its sole discretion, to:

  • Deny entry
  • Disqualify participants
  • Modify, suspend, or terminate participation

for safety concerns, rule violations, misconduct, or actions that threaten participants, the public, or the integrity of the event.


12. MEDIA RELEASE

Participants grant TGARR the irrevocable right to use their name, image, likeness, voice, and vessel for promotional, documentary, educational, or commercial purposes without compensation.


13. GOVERNING LAW & VENUE

This Agreement shall be governed by the laws of the state in which TGARR LLC is organized, without regard to conflict-of-law principles.

Any legal action shall be brought exclusively in courts of competent jurisdiction within that state.


14. SEVERABILITY

If any provision of this Agreement is held to be unenforceable, the remaining provisions shall remain in full force and effect.


PRIVACY POLICY

Information We Collect

TGARR may collect:

  • Name, email address, phone number
  • Emergency contact information
  • Vessel and team information
  • Registration and payment details
  • Website usage data (cookies, analytics)

How We Use Information

Information is used to:

  • Administer event registration
  • Communicate updates and safety information
  • Maintain emergency readiness
  • Improve website performance
  • Comply with legal obligations

Information Sharing

TGARR does not sell personal information.

Information may be shared:

  • With service providers supporting registration and payment
  • When required by law or government authority
  • In emergencies involving participant safety

Data Security

Reasonable administrative and technical safeguards are used to protect personal information. No system can be guaranteed 100% secure.


Cookies & Analytics

TGARR may use cookies and third-party analytics tools to understand website usage. Users may adjust browser settings to limit cookies.


Children’s Privacy

TGARR is not intended for individuals under 18 without parental or legal guardian consent.


Policy Updates

This policy may be updated periodically. Continued use of the website constitutes acceptance of any changes.
